Terms and conditions for using ApplyFast services.

Please read these Terms and Conditions ("Terms") carefully before using ApplyFast ("Service", "we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using ApplyFast, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

ApplyFast is an AI-powered platform that helps users tailor their CVs (resumes) and generate cover letters to match specific job descriptions. Our Service includes:

  • CV tailoring and customization based on job descriptions
  • Cover letter generation
  • Application tracking and management
  • Chrome extension for capturing job details from job boards
  • PDF export functionality

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

4. Payment and Subscriptions

4.1 Subscription Plans

ApplyFast offers various subscription plans with different features and usage limits. By subscribing, you agree to pay the fees associated with your chosen plan.

4.2 Billing

  • Subscription fees are billed in advance on a recurring basis (monthly or annually)
  • All fees are non-refundable except as required by law
  • We reserve the right to change our pricing with 30 days' notice
  • If payment fails, we may suspend or terminate your access to the Service

4.3 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will continue to have access to paid features until the end of your billing period.

5. User Content

5.1 Your Content

You retain ownership of all content you upload to ApplyFast, including:

  • Your CV/resume
  • Job descriptions
  • Cover letters generated using our Service
  • Application tracking data

5.2 License to Use Your Content

By uploading content to ApplyFast, you grant us a limited, non-exclusive license to:

  • Process and store your content to provide the Service
  • Use your content to generate tailored CVs and cover letters
  • Improve our AI models and Service quality (with appropriate anonymization)

5.3 Content Restrictions

You agree not to upload content that:

  • Violates any laws or regulations
  • Infringes on intellectual property rights
  • Contains malicious code or viruses
  • Is offensive, defamatory, or harmful
  • Violates privacy rights of others

6. AI-Generated Content

6.1 AI Processing

Our Service uses artificial intelligence to analyze job descriptions and tailor your CV. While we strive for accuracy, AI-generated content may contain errors or inaccuracies.

6.2 Your Responsibility

You are responsible for:

  • Reviewing all AI-generated content before use
  • Ensuring the accuracy and appropriateness of tailored CVs
  • Verifying that generated content does not contain false information
  • Complying with all applicable laws and regulations

6.3 No Guarantees

We do not guarantee that:

  • Tailored CVs will result in job offers or interviews
  • AI-generated content will be error-free
  • Your CV will pass all Applicant Tracking Systems (ATS)

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.

8. Intellectual Property

8.1 Our Rights

ApplyFast and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 Your Rights

You retain all rights to your original content. You grant us a license to use your content only as necessary to provide the Service.

9. Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Use automated systems to access the Service without permission
  • Share your account credentials with others
  • Resell or redistribute the Service without authorization

10. Limitation of Liability

10.1 Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPLYFAST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10.3 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless ApplyFast and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your content

12. Termination

12.1 By You

You may terminate your account at any time by contacting us or using account deletion features.

12.2 By Us

We may suspend or terminate your access to the Service immediately, without prior notice, if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • We are required to do so by law
  • You fail to pay applicable fees

12.3 Effect of Termination

Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account and content
  • You will not be entitled to any refund of fees paid

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website
  • Sending an email to your registered email address
  • Displaying a notice in the Service

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.

15. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through good faith negotiation. If a resolution cannot be reached, disputes may be resolved through binding arbitration or in a court of competent jurisdiction, as applicable.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ApplyFast regarding the Service and supersede all prior agreements.
